Konsep mahar berupa jasa menurut Imam Syafi’i dan Abu Hanifah serta relevansinya dalam hukum perkawinan Islam di Indonesia

Skripsi ini adalah hasil penelitian kepustaan. Adapun masalah yang akan diteliti ialah: Bagaimana konsep mahar berupa jasa menurut Imam Syafi’I dan Imam Abu Hanifah?, Apa persamaan dan perbedaan konsep mahar berupa jasa menurut Imam Syafi’I dan Abu Hanifah?, Dan Bagaimana relevansinya pemberian mahar berupa jasa dalam hokum perkawinan islam di Indonesia. Penelitian ini menggunakan metode deskriptif komparatif. Data penelitiannya bersifat kualitatif, diperoleh melalui teks (text reading) dan selanjutnya dianalisis dengan menggunakan pola pikir deduktif dan komparatif. Hasil penelitian ini menunjukkan bahwa konsep mahar berupa jasa, menurut Imam Syafi’i, membolehkan mahar yang berupa jasa atau manfaat yang dapat diupahkan sah dijadikan mahar sedangkan menurut Imam Abu Hanifah tidak membolehkan, karena mahar harus bersifat materi yang secara nyata diberikan pada istri. Mengenai mahar yang berupa membacakan atau mengajarkan ayat-ayat al-Qur’an Imam Abu Hanifah menghukuminya fasad terhadap maharnya, sehingga tidak boleh dijadikan mahar, namun darinya wajib dibayar mahar mistil. Sedangkan persamaan dari kedua Imam madzab ini adalah sama-sama menghukumi sah dalam pernikahannya. Keterkaitan pemberian mahar berupa jasa dalam akad perkawinan islam di Indonesia dengan konteks sekarang ini sesuai dengan KHI, bahwa mahar boleh berupa barang, uang atau jasa yang tidak bertentangan dengan hukum Islam (KHI Pasal 1 sub d). Mahar itu bisa berdasarkan asas kesederhanaan dan kemudahan serta berdasarkan kesepakatan kedua belah pihak baik bentuk dan jenisnya (KHI Pasal 30 dan 31). Hal ini sejalan dengan pandangan Imam Syafi’i dimana mayoritas umat muslim di Indonesia kebanyakan adalah menganut paham mazdab Imam Syafi’i.Sejalan dengan kesimpulan tersebut, penulis memberikan saran 1. Seiring perubahan zaman, maka problem umat semakin kompleks, maka penyelesaian yang arif dan bijaksana, yang diambil dari dasar utama hukum Islam, yaitu al-Qur’an dan as-Sunnah, dan hukum-hukum yang lahir dari keduanya. Bagaimana pun juga dasar hukum Islam yang telah diyakini itu sebagai petunjuk dan mampu memberikan jalan keluar dari problem tersebut dan perlu ditafsirkan kembali sesuai dengan kebutuhan umat saat ini. 2. THE EFFECT OF INBREEDING ON THE EARLY PERFORMANCE OF FRESHWATER PRAWN, Macrobrachium rosenbergii

Inbreeding depression has often been considered to be responsible for the deterioration of performance in aquaculture species. Despite a crucial impact that may result from inbreeding depression, comprehensive information reviewing this subject is limited. This study was aimed to gain information on the effect of inbreeding on the early performance of freshwater prawn. The study was performed by comparing performance of inbred and outbred populations. Inbred population was established by brother-sister mating (inbreeding rate of 25%) while the outbred population was formed by mating unrelated individuals. Several fitness and productivity related traits including survival, the rate of larval development, stage dispersion and growth of larvae were evaluated. Results suggest that inbred families performed poorer than that of the outbred in survival. However, inbreeding depression did not seem to occur in other traits including the rate of larval development, larval stage dispersion and growth. This study implies that to maintain genetic quality of farmed prawn stocks, inbreeding rate in farmed population must be controlled not to exceed that level. Implications that these findings may have on aquaculture practices and possible alternatives for the solutions are discussed

This research aims to determine the practice of penalties for taking time Mudharabah deposits before maturity in the perspective of Islamic law at Bank Syariah Mandiri Bengkalis Sub-Branch Office. This research is based on primary and secondary data. Based on the results of the study note that there are customers of Bank Syariah Mandiri Bengkalis Sub-Branch Office who take deposits Mudharabah before maturity, then the customer will be subject to a penalty against funds deposited. By looking at the practice of penalties carried out by Bank Syariah Mandiri Bengkalis Sub-Branch Office is not appropriate and deviates from the theories that apply in Islamic economics. This is because the penalty agreement is not written clearly in the agreement document

This paper discusses the development of optimization model for supplier selection and order allocation considering price discounts and quality of the components that are measured based on expectation of quality loss cost. The approach which was used quadratic loss function to estimated quality loss. The development of model is based on the drawback of previous research; where quality was measured only by defective components without considered to any loss of quality due to deviation from quality characteristics target. Kompetensi Manajerial Kepala Madrasah dalam Mengembangkan Kinerja Tenaga Pendidik dan Tenaga Kependidikan

This study aims to determine the managerial competence of madrasah principals in developing the performance of teachers and education personnel (management study of the principal of Madrasah Aliyah Negeri 1 Pati in Pati Regency). This research was conducted on the implementation of pedagogic competence development at Madrasah Aliyah Negeri 1 Pati which was carried out by the head of madrasah to develop the performance of teaching staff and education personnel. The methodology in this study uses a qualitative approach. Data collection techniques in this study are by observation, interviews and documentation. The method used to check the validity of the data is the triangulation method. Data analysis in this study used qualitative analysis. The results showed that the Principal of Madrasah Aliyah Negeri 1 Pati management of pedagogic competence development at Madrasah Aliyah Negeri 1 Pati included: a) Planning for the head of the madrasah in developing the competence of teachers and education personnel at Madrasah Aliyah Negeri 1 Pati by preparing a work program that was initiated. by deliberation with the teaching staff and education staff in accordance with the regulations set by the government. b) The organizing that was carried out by the Head of Madrasah Aliyah Negeri 1 Pati was to realize the school development policy, especially the development of the competence of teachers and education staff in forming a work team for the quality of decision making. c) the implementation of the Principal of Madrasah Aliyah Negeri 1 Pati, where teaching staff and education personnel realize several main aspects in the program of competency development for teaching staff and education personnel, by disseminating the implementation of competency development for teachers and education personnel, d) Supervision of the Head of Madrasah Aliyah Negeri 1 Pati realized all the activities that were attended by educators and education staff in developing the competencies they mastered
